Signing the contract can be a very scary experience, but with the help of an agent and doing a little homework, it will become very easy.
The contract is basically an agreement between the Buyer and the Seller to perform a simple action. The Buyer agrees to take the steps necessary to pay for the home and the Seller agrees to build a home free from defects and to the specifications of the Buyer.
The contract itself outlines the terms of the sale. What is expected of the Buyer and what is expected of the Seller. It will include the exact legal description of the land and the location of the house as well as the price and the terms of the financing for the loan. It will also include details on the following:
Earnest Money The amount of earnest money required by the Seller from the Buyer in order to secure the agreement is explained. The earnest money is a deposit given by the buyer to the seller which shows that the prospective buyer is serious a purchasing a home or property. This gives the Seller collateral to take the house off of the market and start making changes to personalize it to the Buyers specifications. The earnest money can be used towards the down payment for purchase or returned at the time of closing depending on the type of loan obtained.
Selections and Specifications of the Home This part of the contract is one of the most useful sections. It will include the specifications of the home that are standard and that will be included at no additional charge. Also included in this section you can find the options and upgrades available to personalize the house to make it yours!
Inspection Information This section of the contract will describe what is required to have the home independently inspected for safety and quality. This is not always necessary since the home goes through a rigorous checklist and numerous inspections by a government municipality, but if you chose you can have an independent party come to inspect the home. The inspector will evaluate the home and verify that the home is safe and free of defects.
Warranty Information All Capital Design homes include a one year materials and workmanship warranty as specified in the Greater Atlanta Home Builders Association Homeowner Handbook.
